An amendment has been made in the Article 3 of the Regulation on Fines to Apply in Cases of Agreements, Concerted Practices and Decisions Limiting Competition, and Abuse of Dominant Position and published in the Official Gazette dated 15.06.2022 and numbered 31867.
Pursuant to the amendment; by adding to the definition of annual net income, it is stated that “for whatever reason, in case it is determined that the undertakings have accounted for their (main) operating income, under the account items that are not taken into account in the calculation of net sales such as ordinary income or profits from other activities, the said amounts will also be taken into consideration while determining the annual gross income”.
The relevant amendment entered into force on 15.06.2022, on the publication date.
